Steps Need to Follow to Get USA EB5 Visa

This is also known as the Investor Immigrant Program. It is a flexible visa; the requirements are not strict concerning business experience, age or language. Residents with USA EB5 visa are not mandated, and professional relations in their home country are also not hindered.

On the basis of a qualifying U.S investment, EB5 Visa provides you a green card before you migrate. You are not required to manage the day to day affairs of a business; you need to invest in a new business. With a USA Green Card, you are allowed to live anywhere in the U.S. regardless of where the investment is made.

EB5 investment can be in the form of equipment, inventory, secured indebtedness, cash, tangible property or the equivalent in cash which is valued based on U.S dollar fair-market value.

When the petition of the foreign national investor gets approved, the investors together with their dependents will be granted conditional permanent residence which is valid for 2 years. It gives eligible applicants the opportunity to gain permanent residency.

Investment Eligibility Criteria

USA EB5 Visa applicants are mandated to invest in a new commercial enterprise (any profit-aim activity started for continuing conduct of lawful business) be:

  • Established after Nov. 29, 1990
  • Established on or before Nov. 29, 1990
  1. Purchased and a new enterprise is formed by restructuring or reorganizing the old
  2. Expanded through the investment to ensure a 40-percent increase in the net worth or number of employees occur

Required minimum investments criteria are:

General: $1 million is the minimum qualifying investment in the U.S.

Targeted employment area (rural area or high unemployment): the minimum qualifying investment in a rural or high unemployment area in the United States is $500, 000.

Job creation requirement

Creation or preservation of at least 10 full-time jobs (direct or indirect) for worthy U.S. workers within two years of the immigrant investor’s entry to the U.S as a conditional U.S. permanent resident.

Documents required

  • Document evidence proof confirming the investment
  • Document evidence proof that you will have active involvement I the management of the new enterprise
  • Document evidence of jobs creation

Visa fee

Visa fee for immigrant investor or EB5 visa is $1,500

Application for the registration of the permanent residence is $985
