How to Apply for Dependent Visa (K1)

USA Fiance(e) Dependent visa gives the opportunity for U.S. citizens that want to bring foreign national fiance(e) living abroad to the U.S. for purposes like visitation and marriage. The technical name of this visa is a K1 Visa.

The first step in applying for K1 non immigrant visa for your fiance is to file a Form 1-129F, Petition For Alien Fiance(e). Your marriage must be valid; based on genuine interest to establish a life together and not for the sole purpose of getting an immigration benefit. The period of validity of this visa is 90 days. If the K1 visa was applied for to marry, then the marriage must be within the 90 days of validity. The foreign citizen can thereafter (after the wedding) submit an application for status Adjustment to a Permanent Resident (LPR) with the DHS (Department of Homeland Security) and USCIS (U.S. Citizenship and Immigration Services). People who are already married or planning to marry outside of the U.S. are not eligible for fiance(e) visa.

Documents required

K1 visa requirements include the following:

  • Document indicating that you have enough funds to cover your 90 day's stay
  • Document of proof of accommodation (applicants who will be staying with their fiance or fiance's family need to provide invitation letter while those who will stay in the hotel need to give the confirmation of hotel booking)
  • A passport considered valid for travel to the United States (it should have a validity date that exceeds your intended period of stay with at least six months.
  • Evidence of relationship with your U.S. based fiance
  • Document showing your intention to marry within 90 days if this is the purpose of the immigration
  • Documents showing legal termination (by death, annulment or divorce) of previous marriages
  • Confirmation to show that you met each other physically within two years of filing the petition.

Exceptions for Waiver

  • If the requirement to be met would violate strict and long-established customs of you or your fiance(e)'s foreign culture or social practice
  • If you can adequately prove that the requirement to meet would result in extreme hardship for you.
