For candidates that wish to apply for spouse immigration or life-partner immigration as a permanent choice, the key extra requirements are:

• The candidates must have been in a living relationship with or married to the South African citizen or sponsoring South African Permanent Resident for a period of five (5) years.
• Where candidates immigrating to South Africa are granted permanent residency, such candidate will need to prove that the relationship is still in existence two years after the permit is issued. If evidence of this is not satisfactorily supplied, a permanent resident’s permit can be revoked.
• After a total of five (5) years, the Visa will no longer be subject to the continued existence of your relationship with your partner. At this stage, it cannot be withdrawn because of a change in marital or relationship status.
• Based on the fact that a permanent residency permit can take up to two years to be given, you can apply for a temporary residence while at the same time applying for permanent resident status.

Can I Work or Study on a Spousal Visa?

In South Africa, a foreign spouse that possesses permanent residency is allowed to work freely, without any issues. You can also be allowed to start a business or study in South Africa. However, if the foreign spouse or partner only possesses temporary South African spousal visa, they are required by law to get the endorsement.
